PCPNDT कायद्यात आपले स्वागत आहे
गर्भधारणा पूर्व व प्रसवपूर्व निदान तंत्रे (नियमन आणि गैरवापर प्रतिबंध) कायदा, 1994 याचे उद्दीष्ट खालीलप्रमाणे आहे -
• गर्भधारणेपूर्व किंवा गर्भधारणेनंतर लिंगनिवडीवर प्रतिबंध.
• प्रसवपूर्व निदान तंत्रांचे नियमन.
• प्रसवपूर्व निदान तंत्रांच्या गैरवापरास प्रतिबंध.
महत्त्वाच्या तरतुदी:-
• लिंगनिश्चिती करणे कायद्याने प्रतिबंधित आहे.
• या कायद्यातील आणि नियमांचे कोणतेही उल्लंघन केल्यास तीन वर्षांपर्यंतच्या तुरुंगवासाची आणि दहा हजार रुपयांपर्यंतच्या दंडाची शिक्षा होऊ शकते. तसेच, पुन्हा दोषी आढळल्यास पाच वर्षांपर्यंतच्या तुरुंगवासाची आणि पाच हजार रुपयांपर्यंतच्या दंडाची शिक्षा होऊ शकते.
• कलम 23 (2) नुसार, नोंदणीकृत वैद्यकीय व्यावसायिकाचे नाव योग्य प्राधिकरणाद्वारे संबंधित राज्य वैद्यकीय परिषदेच्या निदर्शनास आणले जाईल. यामध्ये आवश्यक कारवाईसाठी, म्हणजेच, न्यायालयाने आरोप निश्चित केल्यास नोंदणी निलंबित करणे आणि दोष सिद्ध झाल्यास पहिल्या गुन्ह्यासाठी पाच वर्षांसाठी नाव काढून टाकणे आणि पुनरावृत्ती झाल्यास कायमस्वरूपी नोंदणी रद्द करणे याचा समावेश आहे.
• गर्भवती महिलेस या कायद्याच्या उल्लंघनापासून सवलत आहे, कारण असे गृहीत धरले जाते की ती तिच्या पतीने किंवा इतर नातेवाईकांनी या तंत्रांचा अवलंब करण्यास भाग पाडली असेल, जोपर्यंत याच्या विरुद्ध पुरावे सादर केले जात नाहीत.

The Pre-Conception & Pre-Natal Diagnostic Techniques (Regulation and Prevention of Misuse) Act, 1994 aims for-
• The prohibition of sex selection before or after conception.
• Regulation of Pre-Natal Diagnostic Techniques.
• The prevention of misuse of Pre-Natal Diagnostic Techniques.
Imp Provisions:-
• Determination of sex prohibited under the law.
• Any contravention of the provisions of the Act and Rules shall be punishable with imprisonment for term with may extend to three years and with fine which may extend to ten thousand rupees and on any subsequent conviction, with imprisonment which may extend to five years and with fine which may extend to five thousand rupees.
• According to sec. 23 (2) the name of the registered Medical Practitioner shall be reported by the Appropriate Authority to the State Medical Council concerned for taking necessary action including suspension of the registration if the charges are framed by the Court and till the case is disposed of and on conviction for removal of his name from the register of the Council for a period of five years for the first offence and permanently for the subsequent offence.
• The pregnant woman is exempted presuming that pregnant woman was compelled by her husband or any other relative to undergo such techniques, unless contrary is proved.
